VAMED Vitality World Gift Card


1.    Scope of Application

These general terms and conditions shall apply on the buyer’s (hereinafter referred to as ‘Customer’) purchase of a VAMED Vitality World Gift Card (hereinafter referred to as "VVW gift card") from Therme Wien GmbH & Co KG represented by Therme Wien Ges.m.b.H (hereinafter referred to as "Seller").
 
These general terms and conditions, as well as all correspondence and all other information shall be in German or English language. The amounts shall be invoiced in EUR. When ordering or purchasing a gift card, the Customer recognizes and accepts the general terms and conditions valid at the time of purchase.
 
2.    Subject of the Agreement

VAMED Standortentwicklung und Engineering GmbH is the owner of the registered, international logo ‘VAMED VITALITY WORLD’. The VVW gift card is a product of VAMED Standortentwicklung und Engineering GmbH. 

The VVW gift card is a prepaid bank card with a magnetic strip and a bar code. Alternatively, Customers may also purchase VVW gift cards online as a print@home-voucher. The credit amount on the card may range from a minimum of EUR 20.00 to an upper limit of EUR 1,000.00 (for Classic cards) and from a minimum of EUR 500.00 to an upper limit of EUR 5,000.00 (for Premium cards).

The use of the VVW gift card is not linked to the buyer. It can be used by any person. The owner may freely transfer the VVW gift card for private use. However, commercial trading of the VVW gift card by the card holder (e.g., via internet platform) is prohibited.

3.    Online Orders

Customers may select the desired VVW gift card and put it into the shopping cart on the website. If a customer clicks on the PLACE ORDER WITH OBLIGATION TO PAY button, a binding proposal to purchase the goods in the shopping cart is posted (hereinafter referred to as ‘order’). 

Before ordering, the Customer may view and change his / her order data at any time.

After posting the order, Customers receive an automatic e-mail confirming receipt of the order where they can see the content of the order again. With this confirmation, the purchase agreement goes into effect.

The Seller informs the Customers of the dispatch costs during the order process and again through the shopping cart list before the order is posted.  If a VVW gift card is purchased online, the Seller only accepts the types of payment displayed during the order process.

If possible, VVW gift cards are dispatched within three working days from the order date. Delivery of the VVW gift card to the address specified by the Customer is made by Österreichische Post AG, in accordance with its general terms and conditions. Österreichische Post AG generally reserves five working days for delivery in Austria.

The Customer can also purchase the VVW gift card as an electronic printout ("Print at Home voucher"). The Customer receives the “Print at Home voucher” by e-mail after completing the order.

4.    Redemption and Validity

The VVW gift card may be used in all participating resorts of of VAMED Vitality World (“VVW resorts”). Pursuant to the subject Terms and Conditions, the owner may use the VVW gift card for the cashless payment of services (except external services located in the participating VVW resorts, e.g. hairdressers, shops). Services may be consumed at the VVW resorts at the prices quoted at their cash desks or online. A current list of participating VAMED Vitality World resorts can be found at https://www.vitality-world.com. This list will be updated on an ongoing basis so that new VAMED Vitality World resorts can participate in the VVW gift card programme, while resorts leaving the VAMED Vitality World network will no longer participate in the VVW gift card programme:
Contracts concerning services to be used at individual resorts are made exclusively between the spas operated by VVW resorts and the holders of the VVW gift cards to be redeemed. The Seller shall not be liable for any claims arising from such contractual relationships.

The credit amount of the VVW gift card shall be exclusively used to pay for services at the participating VVW resorts (see point 4. of these GTC). Redemption in cash or refunds are excluded. A credit amount on a VVW gift card is valid for five years from the date of purchase and expires thereafter. 

5.    Loss of the VVW gift Card

The card holder is exclusively responsible for the safe-keeping and use of the VVW gift card. The Seller, VAMED Vitality World or the participating resorts of VAMED Vitality World, shall not replace the VVW gift card in case of loss, theft or damage. 

6.    Disclaimer

Subject to Art. 7, VVW gift cards cannot be returned or exchanged. Cash refunds are also excluded if a VVW resort chosen by a Customer is closed temporarily or completely, no longer participates in the VVW gift card programme or is no longer part of the VAMED Vitality resorts.

7.    Right of Withdrawal for Consumers in the Event of Distance Selling

The following provisions are restricted to Customers who are consumers in the sense of Sec. 1 (1) Austrian Consumer Protection Act (KSchG). They are not applicable to corporate clients, who have no right of withdrawal as described in this paragraph.

If the Customer acquires the VVW gift card by way of distance selling, the Customer has the right to withdrawal pursuant to §11 (1) of the Law on Distance and Off-Premises Selling (Fern- und Auswärtsgeschäfte-Gesetz, FAGG) and in accordance with the following provisions:
Customers have a right of withdrawal for 14 days from the date of receipt of the VVW gift card. They may exercise this right without stating reasons, either in writing or by returning the VVW gift card. In the latter case, Customers must return the VVW gift card in faultless condition and, if possible, in original packaging and with the original invoice. The deadline for withdrawal shall 
be deemed observed if the Customer posts the request for withdrawal within the above-mentioned period of time. Costs for returning shall be borne by the Customer. 

If the VVW gift card has already been paid, the Seller shall refund the paid amount immediately upon receipt of the returned VVW gift card.

The right of withdrawal is excluded once the VVW gift card has been used for the payment of services.

8.    Applicable Law, Place of Fulfilment, Jurisdiction

These Terms and Conditions are subject to Austrian substantive law with the exclusion of conflicts of laws and the United Nations Convention on Contracts for the International Sale of Goods. For Customers who are consumers in the sense of Consumer Protection Act, the compulsory legal provisions of the Customer’s usual country of residence also apply to this agreement. 

The place of jurisdiction is the court for Vienna, Innere Stadt, unless a different place of jurisdiction is imposed by consumer protection regulations.

Privacy policy for the VAMED Vitality World gift card


1.    Purpose of this privacy policy

This privacy policy describes which personal data is processed by VAMED Standortentwicklung und Engineering GmbH ("VSG" or "we") as the controller for the VVW gift card when a VAMED Vitality World gift card (hereinafter: "VVW gift card") is purchased. This privacy policy is aimed at all customers ("you" or "data subject").

We process your personal data in accordance with the EU General Data Protection Regulation ("GDPR") and the other applicable data protection regulations. Where terms are not defined in this Privacy Policy, they shall have the meaning given to them in the GDPR.

2.    What personal data is processed?

As part of this business relationship, we process the personal data that you provide or become aware of; these are first name, surname, address, email address, telephone number, company if applicable, payment data (encrypted), customer account data (orders placed: items, prices, IP address), any texts and images or photos entered for Print at Home vouchers; prepaid card queries (voucher number, date, IP address) (in short, the "data").

3.    For what purposes is the data processed?

The following information is intended to provide an overview of the purposes for which and the legal basis on which we process your personal data in accordance with the GDPR:

  • Processing of the respective business transaction - fulfilment of the contract in accordance with Art 6 par. 1 lit b GDPR

  • Customer support - fulfilment of the contract and VSG's legitimate interest in providing contact points for customer problems and feedback and implementing solutions in accordance with Art. 6 par. 1 lit. f GDPR

  • Marketing for products, services and services of the resorts of VAMED Vitality World, promotions and events as well as news from the resorts of VAMED Vitality World (including the sending of corresponding marketing materials by post, e-mails and contact by telephone) exclusively with the corresponding consent of the member in accordance with Art 6 par. 1 lit a GDPR

If we have asked for your consent to process your personal data, we will only use your personal data within the scope of the consent given (Art 6 par. 1 lit a GDPR and Art 9 par. 2 lit a GDPR). You can revoke your consent at any time with effect for the future by contacting info@vitality-world.com.

4.    Recipients

We may disclose your personal data to the following recipients for the above-mentioned purposes.

  • To VAMED Vitality World resorts participating in the VVW gift card programme for the purpose of redemption and value enquiry and the creation of the VVW gift card on site. A current list of participating VAMED Vitality World resorts ("VVW resorts") can be found at https://www.vitality-world.com. The processing and transmission of the data to the other VAMED Vitality World resorts is necessary for the administration of participation in the VVW gift card programme. If the information is not provided, participation in the VVW gift card programme is not possible.

  • The data is processed for the purpose of providing the electronic system for processing the business case and for marketing purposes by protel hotelsoftware GmbH (Europaplatz 8, 44269 Dortmund), high.one Marketing OG (Gurkgasse 43/Top 2, 1140 Vienna), Datatrans AG (Kreuzbühlstrasse 26, CH-8008 Zurich), TAC - The Assistant Company (Schildbach 211, 8230 Hartberg, Austria), Nexi Germany GmbH (Helfmann-Park 7, 65760 Eschborn) and Incert eTourismus GmbH & Co KG (Leonfeldner Str. 328, 4040 Linz).

  • In addition, data processing is carried out by reprographic companies (printers), software developers/IT service providers/software companies, entry system companies/entry systems, advertising agencies, voucher management systems and other payment service providers which are commissioned by VSG.

  • If disclosure is required (i) by law or regulation or (ii) for the establishment, exercise or defence of legal claims, we may also disclose personal data to competent authorities or courts and other third parties who advise us in this context (e.g. higher-level affiliate companies, law firms).

The data will not be passed on to other third parties.

5.    How long do we store the data?

In general, we only store your personal data for as long as necessary to fulfil the purpose for which it was collected. Beyond this period, we store your personal data to fulfil statutory retention obligations (e.g. to fulfil the 7-year retention obligation under the applicable tax and company law provisions) or as long as other legitimate interests in storage exist (e.g. as evidence for the assertion, exercise or defence of claims in pending or imminent legal disputes).

As soon as there are no legitimate reasons for the continued storage of personal data, it is either deleted or anonymised.

6.    Your rights as a data subject

As a data subject, you have the following rights in particular with regard to your personal data under the conditions defined by law:

  • Information as to whether and which personal data we have stored about you and to receive copies of this data (right of access)

  • Correction, addition or deletion of your personal data that is incorrect or not processed in accordance with the law (right to correction and deletion)

  • Restriction of the processing of your personal data (right to restriction)

  • under certain circumstances, to object to the processing of your personal data or to withdraw consent previously granted for processing (right to object or withdraw consent)

  • to receive the personal data that you have provided to us in a structured, commonly used and machine-readable format and to transfer this data to another controller (right to data portability)

We do not process your personal data for the purpose of making decisions based solely on automated processing (including profiling) which produce legal effects concerning you (Art. 22 GDPR).

In addition, you have the right to lodge a complaint with a supervisory authority if you believe that your data protection rights have been violated. For Austria, the data protection authority (www.dsb.gv.at, dsb@dsb.gv.at, Barichgasse 40-42, 1030 Vienna) is responsible.

7.    Updates to this privacy policy

We may update this Privacy Policy to reflect legal, technical or business changes. When we update this Privacy Policy, we will take reasonable steps to notify you of the changes made. The date of the "last update" can be found at the beginning of this privacy policy.
